Flagstaff Mountain-Town Market (FMTM) is a market/community space supporting Arizona and regional agriculture, local small business, local art, local music, and all people with an emphasis on supporting groups who have been historically marginalized. Flagstaff Mountain-Town Market strives to provide a fun and educational cultural experience to market goers where people can learn more about all the aspects the market supports. 1. FMTM reserves the right to randomly audit vendor sales, and FMTM and/or its Manager have the right to suspend or revoke a vendor's ability to sell at any point. 2. FMTM generally only accepts vendors who personally make, process, grow, or artistically modify what they sell and does not allow resale of any items not personally made, processed, grown, or artistically modified by the vendor; however, FMTM will consider resale if a compelling case or situation exists and also reserves the right to permit sales of these or other items at FMTM's booth. 3. FMTM prioritizes vendors in the following order: vendors selling Arizona grown produce, small businesses selling foods made with Arizona grown produce or other ingredients, handmade items that are made with as many local, compostable, recyclable or otherwise sustainable items as possible, foods made by local businesses not using local ingredients. FMTM does not permit the sale of any factory made items, items produced by big businesses for resale by individuals, items made of plastics or any other unsustainable items. 4. It is expected that vendors unable to attend a market should notify the Market manager at least 48 hours in advance. Full season vendors who fail to notify the manager of an absence within the 48 hour window may lose their seniority for the following year, and non-full season vendors may lose their privilege to sell. Vendor Guidelines The following MUST be received and approved prior to vending: 1. Completed and signed vendor registration and proof of all relevant licenses and health department certifications. 2. Copy of liability insurance for ALL value added vendors. Agricultural vendors and artists may submit a signed indemnity agreement. 3. Payment of all registration fees (unless paying as you go, which is a more expensive but can be a more convenient option for small vendors). 4. Signed EBT/FMNP vendor agreements and crop plans (for vendors accepting food stamps, Double Up Food Bucks, and/or the Farmers Market Nutrition Program only). 5. Vendors must allow a representative of FMTM to inspect farms and facilities to ensure vendors adhere to Rules and Regulations. 6. Vendors will not be allowed to set up if they do not provide all insurance, licensing, tax ID numbers, required fees and signed documents. 7. Vendors are responsible for bringing all items needed to sell. FMTM only provides the space. 8. Only full season vendors are given first right of refusal for the following year. 9. ALL single use food service items must be made of paper or certified compostable products. ALL compostable products MUST be labelled "BPI Certified" or "Compostable". Biodegradable is NOT the same as compostable. No single use plastic products are permitted at the market. You will not be able to sell prepared food, beverages or distribute samples unless these requirements are met. 10. It is encouraged and expected that processed and prepared food vendors use AZ/locally grown fruits and vegetables in their products. Market Safety 1. Flagstaff Mountain-Town Market is a safe, fun, and inclusive space. Any disrespectful actions or comments should be reported to the market manager. The issue will be handled, and any of these actions will be stopped immediately. Any acts of violence, aggression, racism, sexism, or any other type of discrimination will result in immediate removal from the market. 2. Vendors are required to securely attach weights of at least ten pounds (twenty pounds per weight is encouraged) to each canopy leg. If using an umbrella, the weights around the base need to be inspected by the market manager and deemed safe and secure. Any vendor found operating under a canopy or umbrella without proper weights will be asked to take their canopy down. Repeatedly failing to have weights could result in being asked to leave Flagstaff Mountain-Town Market. Possible Auditing Procedures 1. FMTM may choose to randomly audit vendors. The designated auditor will total daily sales at the vending booth. The sales total shall not be shared with the vendor and the vendor shall not ask the auditor for information on the daily sales total. FMTM reserves the right to randomly audit vendor sales, credit, debit and point of sale totals. FMTM and/or its Manager have the right to suspend or revoke a vendor's ability to sell at any point. 2. The FMTM auditor submits the sales total to the Market Manager. The vendor independently submits their total to the Market Manager at settlement. 3. Should a discrepancy exist between the auditor's and the vendor's sales total, the Market Manager will contact the vendor and communicate concerns. 4. Should the audited total be 30% or more higher than the vendor's average sales over the vendor's most recent 10 week market history, the Market Manager may immediately terminate the vendor's privilege to sell or require a follow up conversation or conditions before the vendor is allowed to return to the Market. If an additional audit is required, that audit will be paid for by the vendor (approximately $80.00). 5. FMTM may require a vendor to pay the audited daily fee amount from the audit day, in lieu of the 10%, until such time as deemed appropriate by the Manager. 6. The results of any additional audit and subsequent action on participation with the Flagstaff Mountain-Town Market will solely be determined by Market Managers. No refunds are given for vendor fees should a vendor be expelled from the market. 7. Any serious violation will be reported to the proper authorities. 8. The vendor has the right to appeal the violation to the FMTM owner. Vendors will submit any conflicts, suspected conflicts, and/or concerns regarding the overall market or individual vendors in writing to the FMTM owner via email at flagstaffmountaintownmarket@gmail.com; you will be responded to within one week. Thank you all for your hard work, your passion for your profession/craft, and your commitment to supporting small business, people belonging to historically disadvantaged groups, and our communities!
